The TRO re: Alcohol in Lubbock

This is just a regular example of how people don't see the real or whole story regarding lawsuits. Here is the truth: Yes, some law suits are frivilous and they are most always money driven...because face it, everyone has to pay bills. But what is even more true is that people just don't get that most law suits are actually perfectly logical and probably should have been filed. Problem is, I don't know its entirely possible for attorneys/cops/judges to ever completely rid themselves of any criticism of the justice system.

The current irriation of the general public is regarding a temporary restraining order that was placed on the city of Lubbock. See recently the city voted on an ordinance making Lubbock a wet county and allow the sales of alcohol within city limits. Well the city drafted the ordinance wrong and it was illegal to enforce according to previous case law. So, guess what, the "strip" that has maintained the monopoly on liquor sales filed a law suit. The law suit was completely justified, but it looked bad. The public thinks, oh they're just trying to keep the monopoly and hoard all the money, etc etc. Honestly, thats crap and not whats actually going on but if you want to find out the real story, turn off the local news and go read the file that is completely available to the public. And even if it is does that mean that the city should enforce an illegal ordinance? Uhhh...NO. So who else has standing to file a law suit? Pretty much no one except the "strip" can claim an "injury" so they filed.

Its kind of irritating actually because even when you try to explain it they'll nod along but never really believe you. The problem is, in a way everyone is partially right. It is about the money. Think about it this way though...would you pay an attorney $250+ an hour for something that would give you no monetary benefit? I'm thinking probably not. Maybe for something emotional, say a divorce or adoption, etc but not for the sale of alcohol.

Bottom line: Just because something involves money doesn't mean its the driving factor and stop being so damn pessimistic and cynical.
